Welcome, Creators!

BrainCandy gives you a platform to share your arcade games with millions of players worldwide and earn real money through our fair, transparent revenue-sharing model.

Creator Eligibility

Who Can Be a Creator

• Age: Must be 18 years or older
• Location: Must be a US citizen or EU resident OR have proper tax documentation if outside these regions
• Good Standing: Must not have been permanently banned from BrainCandy for violations of Terms or Community Guidelines
• Tax Compliance: Must provide W-9 (US) or equivalent tax ID for payouts exceeding $600/year

How to Become a Creator

1. Create a BrainCandy account
2. Apply for Creator status via Settings → Become a Creator
3. Agree to this Creator Agreement
4. Complete identity and tax verification
5. Submit your first game for review

Revenue Sharing: The 92/4/4 Split

What Counts as Revenue

You earn the 92% share from:

• SB earned by players playing your game during daily contests
• Direct purchases (future feature: cosmetics for your specific game)
• Sponsorships or branded content within your game (if applicable)

You do NOT earn from:

• Free-to-play gameplay (players don't pay to play)
• Ads served on the platform (BrainCandy absorbs ad revenue)
• Other creators' games

Creator Promise: No Sudden Changes

If BrainCandy ever changes the revenue split, you have:

• 90 days' notice before the change takes effect
• Right to withdraw your games and request a final payout under the old terms
• Ability to continue under the old terms if you don't agree with new terms (limited period)

Payout Schedule & Mechanics

When You Get Paid

• Frequency: Monthly payouts (net-30: paid by the 30th of each month for previous month's earnings)
• Minimum Threshold: $25 USD minimum balance to trigger a payout
• Method: Stripe Connect (direct bank transfer, ACH in US; local transfer methods in other regions)
• Verification: All payouts are subject to fraud review before disbursement

Example Payout Timeline

1. January 1–31: Players play your game, earn SB
2. February 1–5: BrainCandy verifies earnings (fraud check, dispute resolution)
3. February 6–30: Payout processed via Stripe
4. February 28–March 5: Funds arrive in your bank account

Payout Holds & Disputes

Payouts may be temporarily held if:

• Fraud is detected in your game or account (unusual play patterns, bot farms)
• A chargeback or dispute is filed by a player
• Your game violates Terms of Service

Held payouts are released once the issue is resolved or investigated. You have the right to appeal any hold via support@braincandy.im.

Tax Reporting & Compliance

Tax Thresholds

• Under $600/year: No 1099 issued; you still must report income on your tax return
• $600+/year: BrainCandy issues 1099-NEC; you're responsible for self-employment tax

Tax Documentation

Before your first payout, you must provide:

• US Creators: W-9 (Form SS-4 or EIN)
• EU Creators: VAT ID (if applicable) and tax identification
• Other Regions: Tax ID or equivalent per your country's law

Your Tax Responsibility

You are solely responsible for:

• Reporting all earned income on your tax return
• Paying self-employment tax (if required in your jurisdiction)
• Complying with local business registration laws
• Paying sales tax or VAT (if applicable in your region)

BrainCandy provides payouts as earned, but you must manage your own tax obligations. Consult a tax professional if unsure.

Content Ownership & Licensing

Your IP Rights

You retain ownership of all intellectual property in your game. You own the source code, assets, game mechanics, story, art, and any unique features.

BrainCandy's License to You

By uploading a game to BrainCandy, you grant BrainCandy:

• Worldwide, non-exclusive license to host, distribute, and run your game on the platform
• Royalty-free (no additional fees to BrainCandy beyond the 4% revenue split)
• Limited to the platform: BrainCandy cannot sell, license, or distribute your game elsewhere without separate written agreement
• Duration: While the game is on the platform; ends when you remove it or your account is terminated

Your Right to Withdraw

You can remove your game from BrainCandy at any time:

1. Log in and navigate to Creator Dashboard
2. Select your game and click "Remove from Platform"
3. Game is immediately delisted; new plays stop earning revenue
4. Final payout processes at month-end
5. Game is permanently deleted from BrainCandy servers 30 days after removal

Quality Standards & Review

Game Requirements

Before your game goes live, it must pass BrainCandy's review for:

• Functionality: Game runs without crashes, loads in <5 seconds, works on all major browsers/devices
• Content Appropriateness: No hate speech, violence, sexual content, or illegal activity
• IP Compliance: No copyrighted music, art, or code without permission
• Performance: No malware, tracking pixels, or malicious code
• Fair Play: No obvious bugs that break gameplay or allow unfair score inflation

Review Process

1. You submit game with metadata (title, description, thumbnail)
2. BrainCandy team reviews (typically 3–5 business days)
3. Approved: Game goes live immediately
4. Rejected: You receive detailed feedback and can resubmit
5. Escalation: If you disagree with rejection, email support@braincandy.im

Post-Launch Moderation

After launch, your game may be removed if:

• User reports reveal undisclosed IP infringement
• Security vulnerabilities are discovered
• Evidence of cheating mechanics (bots controlling outcomes) emerges
• Community reports sustained abuse or inappropriate content

Notice & Appeal: You will be notified before removal, except in cases of urgent safety risk. You have 7 days to appeal.

Anti-Fraud Policy & Payout Clawback

What We Monitor

• Abnormally high play volumes from a single device/IP
• Impossible win rates or score consistency
• Bot traffic or automation signals
• Collusion (coordinating with players for score fixing)
• Chargeback fraud (disputing payments after earning)

Enforcement

• First Detected Fraud: Payout held, game flagged for review, warning issued
• Confirmed Fraud: Payout permanently denied, 50% of prior month's earnings clawed back, game may be removed
• Habitual Fraud: Creator account terminated, all future payouts forfeited

Clawback Example

January: You earn $1,000 (legitimate)

February: Fraud detected; we claw back $500 (50% of January earnings) for audit purposes

February Payout: $1,000 (February earnings) - $500 (clawback) = $500 paid

Creator Warranty & Indemnification

Your Warranty

By uploading a game, you warrant that:

• You own all intellectual property in the game
• The game does not infringe third-party copyrights, patents, or trademarks
• All licensed content (music, libraries) has proper attribution and licensing
• The game does not contain malware, spyware, or tracking software
• You have legal authority to grant BrainCandy a license to the game

Indemnification

You agree to indemnify, defend, and hold harmless BrainCandy from any claims, damages, or losses arising from:

• Your game's content or gameplay
• Any IP infringement in your game
• Any fraud, cheating, or manipulation by you
• Any player harm caused by your game
• Violation of applicable laws by your game

Termination & Dispute Resolution

Termination by You

You can terminate this agreement at any time by:

1. Removing all your games from the platform
2. Emailing support@braincandy.im requesting account closure
3. Final payout processed within 60 days

Termination by BrainCandy

BrainCandy may terminate your creator status if:

• You violate this agreement or Terms of Service (material breach)
• You engage in fraud, cheating, or IP infringement
• You are banned from the platform for community violations
• You fail to provide required tax documentation after 30-day notice

Notice: You will receive written notice and 14 days to cure, except in cases of urgent fraud or safety risk.

Dispute Resolution

All disputes between you and BrainCandy are governed by the Terms of Service (Section 14), which includes mandatory binding arbitration in [ARBITRATION_VENUE].

• Creator Dashboard: Real-time earnings, game analytics, player feedback
• Game Analytics: Plays per day, average score, churn rates
• SDK & Documentation: API docs for integrating with Stripe, leaderboards, achievements
